12x36 journey: the influence on employee health and the employer’s responsibility
Abstract
The present study aims to analyze the impact on the health of employees who create the 12x36 workday modality, as well as the employer's responsibility for damages caused to employees. It seeks to demonstrate, with the use of a deductive method and an approach that goes through the analysis of a bibliographical review, the evolution of the working day until reaching the standard workday of 8 temporary hours and 44 hours a week, as well as how this aspect is related to the fundamental right to work and health. Regarding the fundamental right to health, the labor legislation and the protection of the employee's health fulfilled constitutionally and in the infraconstitutional legislation are analyzed. Finally, we seek to demonstrate how long working hours directly reflect the occurrence of various diseases and the increase in the recurrence of accidents at work, given the fatigue caused by the lack of rest.
